URGENT CALL TO ACTION: The House Of Representatives Can Choose Our Next President!!

*UPDATE* 11-17-12: The original intent of this post was to present a plan, from a fellow patriot, that seemed to be bullet proof. After consulting legal professionals and others, I have am not certain this plan will work. One of the contentions is that the 2/3rds "quorum" requirement does not apply to the Electoral College; after much deliberation, I believe this is the case, and therefore the strategy as posted below is not as bullet proof as suspected. The good news is, there are obviously a lot of concerned people in this country, like yourself, who want to take action. This post has received 20,000 views in less than 24 hours! Please keep the momentum going. As explained below, we CAN and MUST still do something.

Let me be clear. In my study of the facts, I can attest with no doubt whatsoever, this election was stolen through massive voter fraud. I came across an extremely disturbing blog post today that explains why the RNC seems to be doing nothing about the massive evidence of fraud. Please read about the Consent Decree, agreed to by the RNC, via court settlement in 1982, “Democratic National Committee v Republican National Committee,” Case No. 09-4615. The Decree contains actual consent from the RNC to (among other things) "refrain from having private personnel deputized as law enforcement personnel in connection with ballot security activities." As modified in 1987, the Consent Decree defined "ballot security activities" to mean "ballot integrity, ballot security or other efforts to prevent or remedy vote fraud." In other words, the RNC agreed not to pursue voter fraud issues - ever! How they were duped into signing this decree is beyond me and I'm afraid to see where this goes. Have our elections been manipulated since 1982? Regardless, WE must do something about it or forever lose our beloved country to pre-determined sham elections.

What can YOU do?
  1. ACT IMMEDIATELY because we only have until mid-December before the election is certified and then our only option is to pursue impeachment.

I think the most important action we can take is contact the Attorney Generals in all states (but ESPECIALLY Ohio, Pennsylvania, Virginia, Colorado, Florida, etc.) and request they legally investigate/pursue voter fraud. A list of Attorney Generals in Battleground States is below, and a link to a complete list of State Attorney Generals is also provided.
  5. We can still contact all of the Electors, listed at the end of this post, and voice our concern of voter fraud (send them to ObamaVoterFraud.com) and encourage them not to cast their votes until voter fraud is investigated. You can also encourage freedom-loving Democrat Electors to change their vote to Romney; many States don't bind Electors to vote for who they pledged to vote for and there may be some rogue/wavering Dems in the EC.

If anyone can find a flaw in this strategy, presented by a fellow patriot, please note it in the comments. If this works, it may be a last-resort protection our Founding Fathers left us in our Constitution for a time such as this, when the voice of the people has been completely disregarded and the election has been stolen by foreign influence. This golden egg may just be our only "eject button" to get rid of Barack Obama and restore integrity to our nation once and for all. Below is our plan of attack, followed by a list we need all patriots - everywhere - to start calling immediately. We only have until mid-December!!

THE PLAN:
FROM: Louisianna (Glen Ellerbe) for Mitt Romney-Paul Ryan.
WE do not elect the President. The Electoral College elects the President. The 2012 election does not get decided until Mid-December when the Electoral College cast their votes AND, if enough of them do not cast their vote, the responsibility falls onto the House of Representatives to choose the next President!
According to Article II of the U.S. Constitution AND the 12th Amendment - if 1/3rd of the States do not cast their votes in the Electoral College, then the matter falls onto the House of Representatives to choose the President. In other words, if we pressure Congressmen, State Party Officials, and groups such as Tea Party Patriots, Heritage Foundation, etc., to call on RED States to NOT have their Electors cast their vote - then the House of Reps CAN choose the next President (and Republicans still have the majority - 233 (R) to 195 (D) - in the House of Representatives)!!!
If just 18 RED States agreed to NOT cast their votes in the electoral college – then it goes to the House. And if pressured - they just might do it. We do NOT have to convince ANY democrats – at all. All we have to do is convince 1/3 of the States to NOT cast their electoral college votes. Well more than 1/3 of the States did in fact vote as RED States and they too can see the obvious, wide-spread vote-fraud which has taken place.
So, if the Electors in 18 (of 24) States which Romney won decided to NOT cast their electoral college votes - then the electoral college does not meet the requirement as defined in the Constitution, therefore, the electoral college becomes null and void. The matter then goes to the House.
In every State, each political party chooses its' own “electors”. Then, whichever party wins the popular vote in each State is the party which gets to have its electors cast their vote in the electoral college.
However, according to the Constitution and the 12th Amendment, in order for the Electoral College to have a quorum - then at least 2/3rds of the States must cast their votes.
As stated in the Constitution and the 12th Amendment:
“A quorum for this Purpose shall consist of a Member or Members from two thirds of the States.”
So, if 1/3 of the States (17) do NOT cast their electoral college votes - then it goes to the House of Representatives (not the senate) to elect the next President.
"... if no person have such majority, then from the persons having the highest numbers... the House of Representatives shall choose immediately, by ballot, the President."
The Democrats are stealing this election and it is up to WE, the people, to put the hammer down on their widespread vote-fraud. The founding-fathers gave us the Electoral College for several reasons. Vote-Fraud is one of those reasons. But it is up to us to hold tightly to the Constitution. If we don’t, then we are just as guilty as those who would ignore it. The Constitution can stop the socialist machine in its' tracks. But it is up to YOU to get on the phone and make some noise. Please call your State Party Officials, your Congressmen, and any political groups or organizations ASAP.

What YOU can do is call the contacts below and request a list of Mitt Romney's Electors and their contact info (by law, they must provide this to you). When you get the list, call every one of them or send a letter to every one of them, if all you have is an address, and inform them of this provision in our Constitution, which allows the House of Representatives to choose our president. Then, if the electors are not yet posted here for a given state, please post them in the comments for everyone else to see.

    22. You are forgetting about Puerto Rico, the US Virgin Islands and any other territories that I am forgetting about that also get to vote. Those areas skew the numbers a little so its more than 18 needed for 1/3.

  2. My only concern is the AMOUNT and the ability for Democrats to claim they have 2/3 IF only 1/3 held back.

    I believe THEY Have to have 2/3. So trying to stop ONLY 1/3 still allows them to have their 2/3 vote.
    We need to stop 18 states from casting. I believe the anonymous poster has a point about D.C. making 51. That 3x17=51. So only stopping 17 allows a 2/3 majority.

    Dear SOS Hoseman,
    Due to the PROVEN vote fraud(I won't take your time or the space to provide list, but please feel free to contact me if you would like this information)that has taken place during this election cycle, I respectfully demand that our state NOT cast its electoral vote. If, in fact, just 18 RED States agreed NOT to cast their votes in the electoral college – then it goes to the House of Representatives to decide the next president of the United States. As promised in the Constitution and the 12th Amendment:
    “A quorum for this Purpose shall consist of a Member or Members from two thirds of the States.”
    So, if 1/3 of the States do NOT cast their electoral college votes - then it goes to the House of Representatives (not the senate) to elect the next President.

    "... if no person have such majority, then from the persons having the highest numbers... the House of Representatives shall choose immediately, by ballot, the President."

    The Democrats are stealing this election and it is up to WE, the people, to put the hammer down on their widespread vote-fraud. The founding-fathers gave us the Electoral College for several reasons. Vote-Fraud is one of those reasons. But it is up to us to hold tightly to the Constitution. If we don’t, then we are just as guilty as those who would ignore it.

    The Constitution can stop the socialist machine in its tracks. On January 17, 1961, President Dwight Eisenhower CLEARLY and STRIDENTLY WARNED US OF THIS SOCIAL/MILITARY MACHINE! “The potential for the disastrous rise of misplaced power exists and will persist!     Using a technicality that was intended to provide an alternative process in case of large calamity or war should not be coerced into thwarting the will of the people.

    If you don't believe the election results (and I have a lot of doubts myself), then challenge the ballot counts, the legitimacy of the voter rolls.

    If your believe the President is guilty of high crimes and misdemeanors - push for impeachment and trial.

    If the Democrats were to attempt a similar strategy - many of you would be calling it a treasonous act of sedition, or at least I know I would be!

  17. I don't see how Florida is identified as a Blue State. I live in Florida and we are a battle ground state. Florida hasn't cast a vote in this presidential election. They're still doing recounts. Alan West is requiring one of the recounts in court.

    2. It was left uncertain that Allen West lost because the officials dilly-dallied and the time limit was coming to an end! --In 10 precincts the average of the percentages showed that 142% voted. However, when things are done honestly, a precinct can only have 100%of its registered voters vote. Past statistics tell us that 70% is a normal-high percentage. But in West's case, 142% voted!!and that happened in many precincts throughout the country! (in West's case, either half the people voted twice, or 70% more had to be stuffed votes!) On top of that, there was a box that was right in the area where they were doing a partial recount, and that box never did get opened and accounted for. Even the people who were doing the count were dragging their feet hoping the time-limit would be up!! -- Now let's talk about a library which held over 100 boxes of military votes. They were shipped back to Afganistan; they shipped them back, but they got there too late to be counted. The last 3 election cycles many of the troops' votes didn't get counted. That is massive voter disenfranchisement!!!! We are just fed up with it and we're doing something about it.

    1. Let’s diagram the relevant parts of the 12th Amendment:

    Step one is where the President of the Senate (Harry Reid) counts the electoral votes as already reported. Even if all of the red states refuse to participate, obama wins b/c he supposedly has a majority of all the electoral votes.

    So, we would never get to Step 2 – where the election of the President is turned over to the House, and the election of the Vice President turned over to the Senate.

    2. So now what do we do?

    It is obvious that election fraud was going on in Florida, Virginia, Pennsylvania, & Ohio. I expect there was election fraud in other States as well. It is to the everlasting shame & disgrace of the GOP that it, as an institution, isn’t protesting this. Even Rush Limbaugh is talking about how odd it is that there were 150 or so voting places in some of these 4 States where Romney didn’t get a single vote. Is LTC Allan West of Florida the only Republican politician in the entire Country who has a backbone?

    Romney, Ryan and the Republican Electors from those States where we have good reason to suspect election fraud, need to immediately file lawsuits challenging election fraud. They also have “standing” to challenge obama’s qualifications for office. [To those of us who deal with Facts & Reality and know what The Constitution says, it is obvious that obama is ineligible for office b/c he is not a “natural born citizen”.     Yes, our federal courts are corrupt. But this corruption needs to be laid out before the American People. Romney, Ryan, Republican politicians, talk show hosts, etc. need to be out there every day talking about the fraud in this last election.

    Normally, I oppose filing lawsuits in federal courts b/c I know how corrupt the federal courts are. But there are some good federal judges somewhere (surely). And plaintiffs should ask for whatever injunctions they need to maintain the status quo while the cases are being decided on the merits.

    Every time Republicans lie down and let themselves get walked over by lying & cheating democrats, they abandon Principle, Our Constitution, and Our People.

    So, if anyone has contact with Romney, tell him to roll up his sleeves and FIGHT THIS fraud. He has standing to contest all of this.

I can't remember who they were but I didn't reconise them at all. The machine beside me was shut down. They said it was broke but they started workin on it when I got the machine o vote n they were done with it b4 I even got done voting.. I read everything. I'm not a slow reader.. someone else said they didn't reconise some people on there either. Our area showed Mitt. Yet our big cities were basically the obama winners they said made our state blue. Something don't sound right. Everyone else was Mitt..

      And David, Thank you! Yes, the Vice President of the United States is "President of the Senate" (Art. I, Sec. 3, cl. 4) ; and the President of the Senate (i.e., the Vice President) is the one who counts the electoral votes (12th Amendment, 1st para).

This is to Publius huldah: In 1982 there was a lawsuit between Dems and Repubs- the Repubs said they didn't want to keep bickering and waste $ so as a settlement, the Repubs promised that they would not in the future question a district that was over 50% minority voters. Well, now I know why they didn't have the cahones to challenge all those that were 143% that voted,etc. However, the Dems knew they had something on us and that we couldn't legally challenge those suspect districts. So, in the future- the same thing will continute to happen and those same districts will have a ton of stuffed ballots! I think it's time we get rid of the GOP and start a brand new party since that old lawsuit will keep coming up and biting us in the butt! Given all the military votes that didn't get there on time due to plane schedules (and in 1 case hundreds of boxes of military votes were burned up in a plane crash. I can't believe that we don't make certain all our troops' votes get counted! They were the ones we count on to protect us, and what do we do: not count their votes. What a massive amount of voter disenfranchisement that is and we have it each and every election.

However, since the Civil War there have been two serious attempts by Southern-based parties to run regional candidates in hopes of denying either of the two major candidates an electoral college majority. Both attempts (in 1948 and 1968) failed, but not by much—in both cases a shift in the result of two close states would have forced the respective elections into the House.

Folks, the 2/3rd's mentioned in Article II and the 12th Amendment refers to the quorum of the House if they are required to vote...one member per state, not a quorum of the states sending in the votes of the electors. The electors' votes are counted first. If the electors' votes represent a majority (270) of appointed electors the election counts. It actually would take getting a few of the blue states to change their votes...which would require those states to appoint electors that would favor Romney.

Allen West is doing just that in Florida, but it needs to be happening in Pa. and Virginia. The initial momentum for Romney @ 9 pm was suddenly swamped by 10:30 pm. I am really troubled by the busloads of Chicago folks who were voting @ one small precinct in Wisconsin, nobody is talking out in the open about that. It was a slap in the face to several voters, who were registered as Republicans, when they showed up to vote and were told they had already voted? No public air on that either. When precincts were showing that 99 - 116% of their registered voters had cast ballots I was shocked. National average in past elections run 40 - 60% registered voters making it to the polls, but 116% and no alarm?     Unbound electors
    There is no federal law that requires electors to vote as they have pledged, but 29 states and the District of Columbia have legal control over how their electors vote in the Electoral College. This means their electors are bound by state law and/or by state or party pledge to cast their vote for the candidate that wins the statewide popular vote. At the same time, this also means that there are 21 states in the union that have no requirements of, or legal control over, their electors. Therefore, despite the outcome of a state’s popular vote, the state’s electors are ultimately free to vote in whatever manner they please, including an abstention, with no legal repercussions.     Most of these state laws generally assert that an elector shall cast his or her vote for the candidates who won a majority of the state's popular vote or for the candidate of the party that nominated the elector.
    Over the years, however, despite legal oversight, a number of electors have violated their state's law binding them to their pledged vote. However, these violators often only face being charged with a misdemeanor or a small fine, usually $1,000. Many constitutional scholars agree that electors remain free agents despite state laws and that, if challenged, such laws would be ruled unconstitutional. Therefore, electors can decline to cast their vote for a specific candidate (the one that wins the popular vote of their state), either voting for an alternative candidate, or abstaining completely. In fact, in the 2000 election, Barbara Lett-Simmons, an elector for the District of Columbia, cast a blank ballot for president and vice president in protest of the District's unfair voting rights.
    Indeed, when it comes down to it, electors are ultimately free to vote for whom they prersonally prefer, despite the general public's desire.

    This inconsistency allows for discrepancies in our electoral system. The electors from nearly half of the states can vote however they wish, regardless of the popular will of the state.
    In the founding of our nation, the Electoral College was established to prevent the people from making "uneducated" decisions. The founders feared uneducated public opinion and designed the Electoral College as a layer of insulation from the direct voice of the masses.
    There is no reason, in this modern day, to assign this responsibility to a set of individual electors. Hundreds of thousands of votes can and have been violated by an individual elector, choosing to act on his or her own behalf instead of the behalf of the people.
    As of the 2008 election, since the founding of the Electoral College, 157 electors have not cast their votes for the candidates who they were designated to represent.

  34. Something needs to be done to stop what took place on November 6th. If we bow over and accept illegal elections we might as well not vote. Most States have NOT even counted their votes and the race was called for Obama. None of the States I have talked to have rejected the fraud votes that were placed by illegal voters. I talked to the Election Commission in PA. the other day about the fraud and in the course of that conversation I found out there are over 300,000 votes that haven't even been counted yet. How can politicians and the media determine that Obama is the President? Why have an election if they are going to decide? We need to fight this the same as Allen West is fighting. As Americans we have the RIGHT TO KNOW HOW MANY LEGAL VOTES BY LEGAL VOTERS WERE CAST and the totals. I have talked to the legal dept at RNC twice and I have no clue why they are not fighting this. Something is seriously wrong and we the people need to take this fight on and not settle.

    In the Electoral College as per the XII Amendment the rule is this:

    "The person having the greatest number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed"

    A Majority of Electors would need to not cast their vote.

  38. The quorum is only necessary if a majority vote is not cast. Pulling 18 states out of the vote would just leave a smaller number to cast a majority. In order to force a quorum we would have to force a tie vote.

  39. You've misread it. All that is necessary for the election of a President is a majority of the "whole numbers of electors appointed". So you'd need to get about 270 of them to stay home. The two-thirds requirement applies to the House of Representatives.

    Voting for Obama in a state election was not illegal because one wasn't actually voting for Obama; he was voting for an elector whose vote, although expected for Obama, was not yet officially determined. But the action of an elector voting for Obama in the Electoral College would be illegal since Obama is not constitutionally qualified for president. Nevertheless, this is fully expected to proceed.

Perhaps instead of not voting at all, we could ask the free agent electors to switch their vote for Gary Johnson, so that there are no "abstain" votes, but enough to keep any one candidate from winning a clear majority (270). If we could get enough votes to Johnson to reduce Obama's number to say, 269, then it would go to the house. However, this is a Damocles sword, as 1) there is not a 100% assurance Romney would be elected by the Representatives, and 2) something of this nature could be used again, the next time it could go in an undesirable direction. Unless of course we the people insist on vote reform to ensure legal and fair elections, and do away with electoral college after this election. Just a thought imho.

This article states, "According to Article II of the U.S. Constitution AND the 12th Amendment - if 1/3rd of the States do not cast their votes in the Electoral College -- then the matter falls onto the House of Representatives to choose the President." However, that is not what the 12th Amendment says. What the 12th Amendment says that if a candidate gets the majority of electoral votes (currently 270), the election does not go to the House of Representatives. If, and only if, the election goes to the House of Representatives, does the "2/3rds of the states" requirement kick in.   58. The candidate is almost always free to demand their own recount no matter how close the race is but that candidate has to pay for the recount if the results of the Election are changed ie. Romney is determined to be the winner.
    I have overseen and called for 2 Congressional race recounts in Oregon. Why are we not pressuring Mitt Romney to demand his recount to save the country and expose the fraud?

    The state of Mississippi is not itself possessed of a right to cast its electoral votes in the election of President and Vice-President.
    Pursuant to Section 23-15-787, Miss. Code Ann., each political party convention by certificate of nomination and each independent candidate by nominating petition must be accompanied by a list of the names and addresses of persons, who must be qualified voters of this state, equal in number to the number of presidential electors to be chosen. Each person so listed executes the following statement, which is attached to the certificate or petition when the same is filed with the State Board of Election Commissioners: “I do hereby consent and do hereby agree to serve as elector for President and Vice-President of the United States, if elected to that position, and do hereby agree that, if so elected, I shall cast my ballot as such for as President and for Vice-President of the United States, inserting in said blank spaces the respective names of the persons named as nominees for said respective offices in the certificate or petition to which this statement is attached.
    In accordance with statute, the official ballots prepared and voted during the general election set forth the words “Presidential Electors For”, followed by each respective Presidential and Vice Presidential candidates’ names. Upon a certified determination as to who received the majority of the popular vote in this State, the Secretary of State shall provide notice in writing to the persons elected, meaning the six electoral candidates named by nomination or petition. These individual electors will meet in Jackson on the first Monday after the second Wednesday in December next following the election and there shall give their individual electoral votes for President and Vice-President. These votes are recorded on a “Certificate of Vote”, which is thereafter sent to Congress and the National Archives. These electoral votes are counted during a joint session of Congress on January 6, 2012.
    The state of Mississippi does not cast six (6) electoral votes. As provided by statute, individuals nominated or named as electors for each presidential and vice-presidential candidate are vested with a vote and entitled by law to cast that vote at the time and place prescribed by law.

  66. The Democrats have engaged in massive vote fraud during the past 2 Presidential elections. Their vociferous attacks upon those who propose Voter ID laws and other means of ensuring honest elections merely demonstrate their committment to using vote fraud to win elections.
    I have read comments by liberals who ridicule those of us who believe in the rule of law, particularly the Supreme Law of the land, the US Constitution. Other liberals have posted comments in other forums promising to visit violence on conservatives who push for honest elections. Some even threatened to kill Mitt Romney should he ultimately win the election.

    But Americans who support honest elections don't capitulate to socialists who threaten them with violence. Socialists typically abhor the principles of separation of powers, checks and balances, and a federal government of limited authority and purposes.

    The electoral college was created, in part, to provide a check on the ability of tyrants to thwart the will of the people by stealing elections via vote fraud.

    I wish to join with other patriotic Americans, who support the rule of law, and oppose the tyranny imposed by those who rig elections, whether by throwing out the absentee ballots of soldiers overseas, or by flooding the voting system with fraudulent voter registrations which are subsequently used by individuals to vote multiple times.
    Democrats who oppose the laws which would prevent such fraudulent practices should be ashamed. Instead, they brazenly oppose laws which support honest and true elections.
    When confronted with evidence of vote fraud, e.g. counties with more registered voters than residents, I have heard Democrats laugh and ask "so what? We won."

    But Americans stand up to such people. We don't roll over and allow such brazen dishonest practices to destroy our voting system.

  86. This process will not work. I have posted how that 24 states have electors that are not compelled by state or federal statute to vote with the popular vote of their state. In short, given the fiasco since election day, over development in the Middle East. The electors of those 24 states should receive millions of calls and letter from Americans encouraging them to vote their conscience. If 42 electors declined to support Obama, whether they switched to Romney or not, then the House could choose the next president. Given the choices Paul Ryan could be shoe-in.

  89. If you want a legal and constitutional approach, then a better approach is to convince one of the 538 electors in the electoral college to request the birth certificate under Hawaii Statute 338-18(g)(2),

    , which permits release of Hawaiian vital records (including but not limited to birth certificates) to:
    "A governmental agency or organization who for a legitimate government purpose maintains and needs to update official lists of persons in the ordinary course of the agency's or organization's activities;"

    To be fair ask for the birth certificates of Romney, Stein, Johnson, Goode, etc. as well.

    The Electoral College is a governmental body. One of the purposes of the College is to compile a list of people eligible to hold the Office of the President of the United States and then cast ballots for President and Vice President. All of the federal cases on the certificate matter have been dismissed for lack of standing to pursue the matter. An elector of the Electoral College though would have standing to question and examine the qualifications of a candidate to the Office of the President and Vice President of the United States. Moreover, if the Hawaiian Department of Vital Records refused to release under HRS 338-18(g)(2), then that elector has standing in federal court to request the federal court to order the Department to release the record. If so ordered, then HRS 338-18(b)(9) is in play and it reads:
    “A person whose right to inspect or obtain a certified copy of the record is established by an order of a court of competent jurisdiction;”

    Remember in the Arizona Secretary of State flap the Hawaiian government specifically used HRS 338-18(g)(2) to block the SoS request and insisted the Arizona SoS needed to demonstrate that
    1) He maintains some sort of official list which required the Hawaiian birth certificate and
    2) that that list was routinely maintained by the office of the SoS of Arizona.

    That exact argument (do you routinely maintain a list which requires access to a Hawaiian vital record?) though backfires if an elector of the Electoral College is the one doing the asking.

    I grant that finding an elector willing to help Obama settle this or one hell bent on pursuing the question would be the hard part. But the law and Constitution would at least (for once) be on their side and there are 538 bites at that apple available.

    Am I missing something obvious here?
